Terms and Conditions

A. Definitions
All There Is, coaching & circling, the contractor, represented by Martje Witzel
Participant: the natural person participating in a training. For readability purposes, the participant will be addressed as 'you' in this document from section C onwards.
Training: workshop, training, course, education, online program, or any other gathering/form for individuals in group settings with the aim of conveying and increasing knowledge and skills and promoting personal and professional growth.
Facilitator(s)/ leaders : Martje, other facilitators/ leaders, and assistants.
Team Members: Martje, other facilitators/ leaders, and assistants.
Conditions: these General Terms and Conditions.

B. Applicability
The conditions apply to all offers, (legal) acts, and agreements of All There Is. Changes to or additions to the conditions are expressly and in writing confirmed by All There Is. Registration as mentioned in article D section 1 implies acceptance of the applicability of these conditions. The applicability of the client's general terms and conditions is excluded insofar as they conflict with these conditions.

C. Provision of Information & Privacy
The information about trainings that you as a (potential) participant can find on the website, in brochures, or in other forms of communication is as truthful and accurate as possible. We respect the advertising code for courses. This means that descriptions of trainings (advertisements) provide a correct image of All There Is and the trainings themselves. It also means that we do not promise results in advertising that are not achievable. It also means that we respect other organizations with a similar offer as competitors and refrain from aggressive competitive expressions. We do everything possible to comply with the General Data Protection Regulation (GDPR). The privacy policy of All There Is is described in the privacy statement which can be viewed via www.all-there-is.com.

D. Registration and Confirmation of Training & Sessions
Registration for a training is done by email, via calendly, via a ticket shop. Upon registration on the website, calendly, or by email, you will receive a confirmation by email. By sending this confirmation, the agreement regarding participation in the respective training is concluded. Upon registration via the ticket shop, you will receive a confirmation from the ticket shop. Upon receipt of this ticket, the agreement regarding participation in the respective training is concluded.

E. Prices of Trainings & Sessions
Upon registration, the prices as stated on www.all-there-is.com or confirmed via email apply. When registering for a training or session based on an offer, the prices as stated in the offer apply. The price includes materials or literature unless otherwise stated. Prices include 21% VAT. Prices may be adjusted based on unforeseen circumstances such as higher costs for locations. Prices may be adjusted due to changes in the VAT regime and/or the applicable VAT rates.

F. Payments by Participants

Registration via the ticket shop:
After registration for a training via the ticket shop, you will receive a payment confirmation.If desired, you can request an invoice including VAT for payments via the ticket shop from All There Is.

Registration by email:
After registration for a training by email, you will receive a payment request via an invoice within two working days. You must pay before the specified date by deposit to an account designated by All There Is. This is stated on the invoice.If you have not paid by the specified date, we reserve the right to refuse participation in the training.

Registration for session via calendly
When booking a session via calendly, you will receive a confirmation email with a zoom link. You will receive a separate email with an invoice.You must pay before the specified date by deposit to an account designated by All There Is. This is stated on the invoice. If you have not paid by the specified date, we reserve the right to cancel the session.

G. Cancellations by Participants

Cancellation of short trainings (evening workshops, day workshops, short (online) courses):
If you cancel up to 21 days before a training, we will refund the amount already paid to you.
If you cancel between 21 days and 7 days before a training, we will refund 50% of the amount due to you. The payment obligation for the other 50% also applies if you have not yet paid.
If you cancel within 7 days before the training, you will not receive a refund or you will be required to pay the full amount if you have not yet paid. If you cancel, you may, after consultation with and permission from the relevant facilitator, allow someone else who meets the requirements to participate in your place free of charge. For courses consisting of multiple days, the date of the first day is the reference date. If you cancel after this first day, we will not refund any money.

Cancellation of multi-day retreats and programs:
If you cancel up to 8 weeks before the start of a training or program, we will refund the amount already paid to you, minus 25 Euro administration fee.
If you cancel between 8 and 6 weeks before the start of the training or program, 25% of the amount due will be charged. This payment obligation also applies if payment has not yet been made.
If you cancel between 6 weeks and 21 days before the start of the training or program, 50% of the amount due will be charged. This payment obligation also applies if payment has not yet been made.
If you cancel in the period of 21 days before the start of the training or program, you are required to pay the entire amount due minus the costs for accommodation if they can still be canceled at the location. This payment obligation also applies if payment has not yet been made.
If you cancel, you can, after consultation with and permission from Martje Witzel, have someone else who meets the admission requirements register in your place. In this case, 25 Euro will be deducted from the refundable amount for administration costs.
For trainings or programs consisting of multiple days or modules, the date of the first meeting (online or in-person) is the starting point.

Cancellation of individual sessions
Sessions can be rescheduled up to 24 hours in advance. For cancellations within 24 hours in advance, the full costs will be charged.

H. Cancellations by All There Is
We have the right to cancel a training at any time. We try to prevent this as much as possible, but if it happens unexpectedly, you will be informed as soon as possible. If possible, we will offer you an alternative in case of cancellation of a training. If you make use of this, the amount will not be refunded or, if applicable, it will be offset. If you do not make use of this, we will refund the amount paid by you within 7 days.

I. Behavior and Boundaries
The general law applies during the trainings & sessions. Additional (behavioral) rules may be communicated during a training or session. If as a participant or team member you do not respect the communicated agreements or boundaries or otherwise display inappropriate behavior, we have the right to ask you to leave the training, or to refuse you access to a subsequent training. This will be done without refund of the paid costs.
Team members will not enter into an intimate/sexual relationship with you as a participant during a training or in the 6 months after a training. If there is a desire from both sides to be intimate earlier, this can be brought to Martje's attention and an inquiry process will follow.
If you as a participant are dissatisfied with the behavior of one or more team members, you can file a complaint (see complaint procedure).

J. Liability
If we ask before or during a workshop, session, or training whether you have health problems or psychological problems, you must answer truthfully. For longer trainings, you might be asked to fill in an extensive questionnaire about your health, psychological state, medication use, life experiences, wishes, and concerns regarding the training.
Team members are not liable for any damage caused by or in connection with participation in a training of ours, unless intent or gross negligence can be attributed to the facilitator(s) and/or assistants.Team members are not liable for any damage caused by the cancellation of a training. If team members are liable for any damage despite the provisions in section 1, 2, 3, or 4, this liability will be limited to a maximum of the invoice amount. Indirect damage will not be reimbursed.

K. Complaints Procedure
If you have a complaint, you can submit it in writing to Martje Witzel and it will be treated with respect. Subsequently, it will be decided together how to deal with the complaint.If it is necessary for a third party to be involved, it is important that both the participant and the team member agree on who that is.

L. Intellectual Property
The material provided during a training or session becomes your property. The rights to intellectual property with regard to the content of the training, the material, and any other documents/products relating to the training are reserved by us. Without express written permission from us, you are not authorized to disclose, exploit, or otherwise reproduce data from and/or portions and/or extracts of the provided material. For example, forwarding parts of online programs to third parties is not allowed.

M. Applicable Law
Dutch law applies to all offers, (legal) acts, and the like of All There Is and agreements between All There Is and the participant. All disputes arising between parties as a result of a registration, offer, (legal) act, agreement, and the like, to which these conditions apply or as a result of agreements arising from them, will be brought before the competent court in Utrecht, unless the law prescribes otherwise.
